Studi Komperatif Pandangan Imam Asy-Syafi’I dan Siti Musdah Mulia Tentang Pernikahan Antar Agama
Abstract
This research aims to compare the views of Imam Asy-Syafi'i, a classical scholar in the Islamic fiqh tradition, and Siti Musdah Mulia, a contemporary scholar and women's rights activist, regarding interfaith marriage. The main focus of this research is to analyze the rationale, arguments and implications of each figure's views on the practice of interfaith marriage in Muslim society.
The research method used is a qualitative approach with text analysis from the works of Imam Asy-Syafi'i, especially in the book "Al-Umm," as well as the writings and publications of Siti Musdah Mulia which discuss marriage and women's rights in Islam. A comparative approach is used to identify similarities and differences in the views of the two figures.
The research results show that Imam Asy-Shafi'i strictly forbids inter-religious marriages, especially between a Muslim woman and a non-Muslim man, based on interpretations of the Al-Quran and Hadith. This prohibition is based on the principle of protecting the faith and honor of Muslim women, as well as the potential risk to children born from these marriages.
In contrast, Siti Musdah Mulia offers a more inclusive and contextual perspective on interfaith marriage. Using a hermeneutic approach and considering the modern social context, Musdah Mulia proposes that interfaith marriages can be accepted provided there is mutual agreement, mutual respect, and a commitment to maintaining each other's religion. This view reflects efforts to fight for individual rights and gender equality within the dynamic framework of Islamic law
